Welcome to Devinity Studios ("Devinity", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our website, marketplace, and related services (collectively, the "Platform"). By creating an account or using the Platform, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old to create an account, buy, sell, or otherwise use the Platform. The Platform is a commercial marketplace for digital products and services and is not directed to or intended for minors. By creating an account, you represent and warrant that you are at least 18 years of age. We may suspend or terminate any account that we reasonably believe belongs to a person under 18.
2. Accounts
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You agree to provide accurate, current, and complete information at registration.
3. Marketplace Role
Devinity Studios operates as a marketplace platform that connects buyers and creators. Devinity is not a party to transactions between users except where expressly stated. We may, at our discretion, mediate disputes but are not obligated to do so.
4. Acceptable Use
- No fraud, harassment, hate speech, or harmful conduct.
- No uploading of stolen, leaked, infringing, or illegal content.
- No chargeback abuse, scams, or misleading listings.
- No attempts to disrupt, reverse-engineer, or exploit the Platform.
- Commission chat, project files, and payment must remain on the Platform. Asking another user to move a transaction, payment, or project communication off-site is prohibited.
- Clients and developers who attempt to bypass Devinity's payment or commission safeguards may be suspended or permanently banned.
5. Fees & Payments
Devinity may collect marketplace fees from transactions. Fee amounts are disclosed prior to purchase or listing. Payment processing may be handled by third-party providers governed by their own terms.
6. Devinity Credits
- Devinity Credits are closed-loop store credits used only on the Platform for digital assets and commissions.
- Purchased credit packs are not legal tender, deposits, or transferable between users.
- Credits earned by developers may be spent on the Platform like purchased credits.
- Only earned credits may be exchanged for cash. Cash-outs pay 86¢ per 100 earned credits, and the minimum cash-out is 2,326 earned credits ($20.00).
- A verified payout account is required for cash-outs. Provider fees, tax withholding, reserves, refunds, fraud reviews, or legal requirements may affect timing or net proceeds.
7. Content & Licensing
You retain ownership of content you upload. By uploading, you grant Devinity a worldwide, non-exclusive, royalty-free license to host, display, market, and promote your listings on the Platform.
8. Termination
We may suspend or terminate accounts that violate these Terms or any other policy, with or without notice. You may close your account at any time.
9. Disclaimers
The Platform is provided "as is" without warranties of any kind. Devinity disclaims all implied warranties to the maximum extent permitted by law.
10. Limitation of Liability
To the maximum extent permitted by law, Devinity will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
11. Changes
We may update these Terms from time to time. Material changes will be communicated through the Platform. Continued use after changes constitutes acceptance.
